Terms of Service
Last updated August 27, 2026
These terms are the agreement between you and WhoHasGear. We've kept them readable instead of burying the important parts. By creating an account you accept them.
1. What we provide
WhoHasGear is software for tracking equipment: you add items, we generate QR labels, and people check gear in and out by scanning those labels. We provide it “as a service” over the web. We may add, change, or remove features as the product develops, but we won't remove something core to a plan you're paying for without telling you first.
2. Your account
- You must be at least 18, or have permission from your organization, to create a workspace.
- You're responsible for what happens under your account, including what your team members do.
- Keep your password to yourself. Tell us promptly if you think it's been compromised.
- One person is the workspace owner. That person controls billing, invites, and deletion.
3. Your data stays yours
You own your inventory data. We claim no ownership over it. We store and process it only to provide the service, as described in our Privacy Policy. You can export everything to CSV at any time, including after you cancel, for as long as your account exists.
4. Acceptable use
Don't use WhoHasGear to:
- Break the law, or help anyone else do so.
- Store malware, or attack, probe, or overload our infrastructure.
- Scrape, resell, or white-label the service without a written agreement.
- Upload content you don't have the right to upload.
- Impersonate someone else, or misuse another organization's labels.
We may suspend an account that does these things. If it's an honest mistake, we'll contact you first.
5. Plans, billing, and the $1 trial
- Free plan. Free, indefinitely, within its published limits. No card required.
- $1 trial. One dollar buys seven days of full Professional access. At the end of those seven days the subscription automatically continues at the regular monthly price unless you cancel first. You can cancel any time during the trial from Settings, in which case you pay only the $1 and nothing else. One trial per workspace.
- Paid plans. Billed monthly in advance through Stripe. Prices are shown before you pay and include no hidden fees.
- Cancellation. Cancel from Settings at any time. Your plan stays active until the end of the period you already paid for, then drops to Free. We don't delete your data when you downgrade — you simply can't add beyond the free limits.
- Refunds. We don't do automatic refunds for partial periods, but if something went genuinely wrong, email us and we'll sort it out fairly.
- Price changes. We'll give you at least 30 days' notice by email before changing the price of an existing subscription.
6. Public scan pages
QR labels you print link to a public page for that item. Anyone physically holding the label can view that item and check it in or out. That is the intended design — borrowers shouldn't need accounts. Don't print labels for anything you wouldn't want a person holding the label to be able to check out.
7. Availability
We work to keep WhoHasGear online and fast, but we don't promise uninterrupted service. Maintenance, outages at our infrastructure providers, and bugs happen. We do not currently offer a contractual uptime SLA; Enterprise customers can ask us for one in writing.
8. Disclaimer
WhoHasGear is provided “as is”, without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. WhoHasGear is a record-keeping tool, not an insurance policy or a security system. We are not responsible for equipment that is lost, stolen, damaged, or not returned. Keep your own insurance and your own procedures.
9. Limitation of liability
To the maximum extent the law allows, our total liability for any claim relating to WhoHasGear is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or the value of missing equipment.
10. Termination
You can delete your workspace at any time. We may suspend or terminate an account that breaks these terms, doesn't pay, or puts the service at risk. If we terminate your account without cause, we'll refund any unused prepaid time.
11. Changes to these terms
We'll update the date above and, for material changes, email account owners. If you keep using the service afterwards, you accept the new terms.
12. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. We'll always try to resolve a dispute by talking to you first — email is faster and cheaper than lawyers for both of us.
13. Contact
